Please read these Terms of Service ("Terms") carefully before using the Hf mobile application (the "App") operated by IE Denis Zhesterev ("we," "us," or "our").
You must be at least 17 years of age to use the App. By using the App, you represent and warrant that you are at least 17 years old and have the legal capacity to enter into this Agreement. If you are under 17, you may not use the App under any circumstances.
Hf is an AI-powered mobile application that provides the following features:
The App uses artificial intelligence technology provided by third-party services (Fal.ai and ElevenLabs) to process and generate content. Results may vary and are dependent on the quality of uploaded content and AI processing capabilities.
Access to premium features requires tokens, a virtual currency system described in Section 8.
3.1 Data Transmission: To provide AI-powered services, your uploaded videos, images, and audio will be transmitted to and processed by third-party artificial intelligence providers:
3.2 Explicit Consent: By using AI-powered features, you explicitly consent to the transmission and processing of your content by these third-party AI services. If you do not consent, you may not use these features.
3.3 Purpose: Your content is processed solely to generate the AI-processed output you requested. Our AI providers do not retain your content after processing.
4.1 Your Content: You retain ownership of all videos, images, and audio you upload ("User Content"). By uploading, you grant us a limited, non-exclusive, royalty-free, worldwide license to process, store, and transmit your content solely to provide the App's services.
4.2 Consent Requirement: BY USING THE APP, YOU REPRESENT AND WARRANT THAT:
4.3 Sole Responsibility: You are solely responsible for ensuring your use of the App complies with all applicable laws and does not infringe upon the rights of any third party. We are not responsible for verifying consent or rights.
5.1 Non-Consensual Content: Creating face-swapped or voice-cloned content using the likeness or voice of any person without their explicit, informed consent.
5.2 Sexual or Explicit Content: Creating, distributing, or sharing any sexually explicit, pornographic, nude, or adult content. This expressly includes non-consensual intimate images ("NCII" or "deepfake pornography").
5.3 Harassment and Abuse: Harassing, bullying, intimidating, defaming, humiliating, or threatening any individual.
5.4 Fraud and Impersonation: Impersonating another person, creating false identities, committing fraud, identity theft, or deceiving others about the authenticity of content.
5.5 Misinformation: Creating or spreading false, misleading, or deceptive content, including political disinformation, fake news, or manipulated media intended to deceive.
5.6 Illegal Activities: Engaging in any activity that violates local, state, national, or international laws or regulations.
5.7 Content Involving Minors: Creating ANY content depicting individuals under 18 years of age, regardless of intent or consent. This is strictly prohibited with no exceptions.
5.8 Hate and Violence: Promoting hatred, discrimination, violence, or terrorism against any individual or group based on race, ethnicity, religion, gender, sexual orientation, disability, or any other characteristic.
5.9 Intellectual Property Infringement: Violating any copyrights, trademarks, publicity rights, or other intellectual property rights.
In accordance with the U.S. Take It Down Act (2024) and similar legislation worldwide, we strictly prohibit the creation, distribution, or sharing of non-consensual intimate images (NCII) generated using our App. This includes any sexually explicit synthetic content created without the depicted person's consent.
Reporting Violations: If you believe content created using Hf depicts you without consent or violates your rights, contact us immediately at hf@priles.dev. Include: (1) your contact information; (2) description of the content; (3) statement that you did not consent. We will review and respond within 48 hours.
We employ automated safety filters provided by our AI processing partners to detect and prevent the creation of prohibited content, including explicit material. We reserve the right to:
8.1 Nature of Tokens: Tokens are a virtual currency used exclusively within the App to access AI-powered features. Tokens have no monetary value outside the App and cannot be exchanged for cash, transferred to other users, or refunded except as described in Section 9.
8.2 Types of Tokens:
8.3 Token Spending Priority: When you use tokens for AI generation, subscription tokens are consumed first. Only after all subscription tokens are exhausted will purchased tokens be used.
8.4 Token Costs: The following operations consume tokens:

Token costs are subject to change. Current costs are always displayed in the App before you confirm a generation.
8.5 Failed Generation Refund: If AI processing fails due to a technical error on our side or our AI providers' side, tokens are automatically refunded to your account. The refund is credited in the same proportions (subscription/purchased) as they were originally debited. You will see the refund reflected in your token balance.
8.6 No Transfer or Cash Value: Tokens cannot be:
8.7 Forfeiture: Upon account termination (whether voluntary or due to Terms violation), all tokens — both subscription and purchased — are forfeited and cannot be recovered or refunded.
8.8 Token Balance: You can view your current token balance (both subscription and purchased) within the App. We are not responsible for unauthorized use of your tokens resulting from unauthorized access to your device.
9.1 Subscription Tiers: The App offers the following subscription plans:

9.2 Subscription Renewal: Upon each renewal, your subscription token balance is topped up to your plan's allocation. Subscription tokens do not accumulate across periods — any unused subscription tokens from the previous period are not added on top of the new allocation. Purchased tokens are not affected by renewal.
9.3 Subscription Changes: If you upgrade or downgrade your subscription:
9.4 Token Packages: You may purchase additional token packages as one-time purchases. These tokens are credited as purchased tokens and do not expire. Available packages:

Prices are displayed in the App and may vary by region.
9.5 Payment Processing: All payments are processed through the Apple App Store. By purchasing, you agree to Apple's payment terms.
9.6 Auto-Renewal: Subscriptions automatically renew unless canceled at least 24 hours before the current period ends. Manage subscriptions in your Apple ID account settings or at https://apps.apple.com/account/subscriptions.
9.7 Refunds: Refund requests for subscription payments or token purchases are handled by Apple per their refund policy. We do not process refunds directly. Note that refunded purchases will result in the corresponding tokens being removed from your account.
9.8 Consent to Share Consumption Data with Apple: By using the App and making in-app purchases, you consent to our sharing of data regarding your usage and consumption of purchased content — including but not limited to the amount of tokens consumed, the time elapsed within the subscription period, and related usage metrics — with Apple, as part of our efforts to process and resolve refund requests. This data is transmitted to Apple solely in response to refund-related server notifications initiated by Apple and is used by Apple to evaluate refund eligibility. If you do not wish your consumption data to be shared in this way, please do not make in-app purchases.
9.9 Price Changes: We may change subscription prices or token package prices with notice. Price changes apply to the next billing cycle for subscriptions.
10.1 Our Property: The App, including its design, features, code, graphics, and trademarks, is owned by IE Denis Zhesterev and protected by intellectual property laws. You may not copy, modify, distribute, sell, or reverse-engineer any part of the App.
10.2 Your Content: You retain all rights to your User Content and content you create using the App. We claim no ownership over your creations.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY OF AI-GENERATED RESULTS. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT AI-GENERATED CONTENT WILL MEET YOUR EXPECTATIONS.
TOKENS ARE VIRTUAL ITEMS WITH NO GUARANTEED VALUE. WE DO NOT WARRANT THAT TOKENS WILL ALWAYS BE AVAILABLE, THAT TOKEN COSTS WILL REMAIN UNCHANGED, OR THAT FEATURES ACCESSIBLE WITH TOKENS WILL CONTINUE TO BE OFFERED.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IE DENIS ZHESTEREV SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, REPUTATION, TOKENS, OR GOODWILL, ARISING FROM YOUR USE OF THE APP OR ANY CONTENT CREATED USING THE APP.
IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100 USD, WHICHEVER IS GREATER.
You agree to indemnify, defend, and hold harmless IE Denis Zhesterev and its officers, directors, employees, agents, and affiliates from any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
We provide tools; you control their use. We are not responsible for how you or others use content generated through our service. You acknowledge that AI-generated face-swap, voice, and image content can be misused and agree to use the App responsibly, ethically, and in compliance with all applicable laws.
We may suspend or terminate your access to the App immediately, without prior notice, for any reason, including breach of these Terms. Upon termination:
Any feedback, suggestions, or ideas you submit through the App become our property. We may use them without compensation or attribution to you.
These Terms are governed by the laws of Georgia, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in Georgia, except where prohibited by law. You waive any right to participate in class action lawsuits.
If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App and supersede all prior agreements.
We may modify these Terms at any time. Material changes will be notified by posting updated Terms in the App and updating the "Last Updated" date. Continued use after changes constitutes acceptance. Changes to token costs or subscription benefits will be communicated in advance where possible.
